Former executive settles retaliation claim against Mylan

A former executive has settled a federal lawsuit claiming that Mylan Inc. fired him when it found out he had filed a whistleblower lawsuit against a previous employer, according to court documents.

U.S. District Judge Joy Flowers Conti Wednesday approved a motion by Matthew Cestra to dismiss the lawsuit. Court records show the company and Cestra reached an agreement earlier this month.

Cestra declined comment. Attorneys for both sides and a Mylan spokesperson couldn't immediately be reached for comment.

The other lawsuit is a pending qui tam case where Cestra, the federal government, 28 states and the District of Columbia contend Cephalon Inc. improperly billed government health programs for unapproved and off-label uses of one of its drugs. Cephalon denies the allegations.
