Bail denied to Ford City man serving time in beating death |

A judge denied a request for bail by a jailed Ford City man convicted for his role in the beating death of a man outside of a Kittanning bar on St. Patrick’s Day last year.

Otilio Cosme, 45, at a court hearing last week requested release from Armstrong County Jail on $25,000 bail while he appeals his 18-month jail sentence for involuntary manslaughter in the death of James Peter Sullivan of Chicora.

Cosme, one of four men charged in the beating outside the Wick City Saloon, pleaded guilty to the misdemeanor charge in August. He was jailed after sentencing in October.

County Court of Common Pleas Judge James J. Panchik denied the request for bail in a written ruling issued Friday. Panchik in the ruling called a release on bail “inappropriate” for the convicted man serving a sentence “proportionate to the crime to which (he) pled guilty.”

The judge wrote that Cosme at sentencing showed “indifference to human life in his actions toward the victim,” and also said he was a flight risk if released on bail.

“There’s a significant possibility that defendant could leave the area pending his appeal,” Panchik wrote. “Defendant had significantly less incentive to leave the area prior to his recent conviction and sentencing.”

Cosme spent 16 months on house arrest before being jailed at sentencing.

He was the second of four men charged to plead guilty for his role in the death of Sullivan. Dennis Andrew Rosenberg, 29, of Ford City is serving three to six years in a state prison for aggravated assault, a felony, and involuntary manslaughter, a misdemeanor.

Trials are pending against Keith Allen Brison, 34, and Anthony Michael Bove, 20, both of Kittanning. Bove’s trial on felony charges of homicide and aggravated assault is Dec. 8. Brison rejected a plea agreement Friday and will stand trial Jan. 13 on felony charges of aggravated assault, criminal homicide and misdemeanor charges of simple assault and reckless endangerment.
