Cecil officials believe company will scrap plans for seismic testing

Cecil officials anticipate a seismic data company that sued the municipality will withdraw its application to test on township roads after a judge denied the company's request for an expedited hearing.

Dawson Geophysical, a Texas corporation with an office in Southpointe, sued the township, claiming an ordinance unlawfully prohibits the company from testing on township roads.

Washington County Court of Common Pleas Judge Janet Moschetta Bell denied the company's request for an expedited hearing on Wednesday.

The township's ordinance allows it to deny use of roads, though the ordinance “provides no framework, criteria or guidelines for that determination,” according to the lawsuit filed last week in Washington County Court of Common Pleas.

Don Gennuso, Cecil manager, said the board was prepared to hold a meeting regarding the application next week, but he received word from the company that it no longer intended to test on township roads. He said he was waiting for written confirmation.

“It seems as if they'll be withdrawing their permit application seeking permission to do testing on township roadways,” he said.

Jeremy Mercer, an attorney for Dawson Geophysical, said he could not comment.
