A LaBelle man will serve at least 39 years in state prison as a result of a court-ordered resentencing, but the minimum term is just one year less than the original sentence.
Fred Augusta Mitchell, 47, was convicted in January 2014 of two counts each of rape, involuntary deviate sexual intercourse, aggravated indecent assault and indecent assault.
State police said Mitchell assaulted a 4-year-old girl.
At the request of Assistant District Attorney Anthony Iannamorelli, Judge Joseph George Jr. in 2014 sentenced Mitchell to mandatory minimums on three of the counts, to be served consecutively, for a total of 40 to 80 years in prison.
On Jan. 22, a panel of Superior Court judges vacated the sentences as unconstitutional and remanded the case for resentencing.
George on Friday resentenced Mitchell in the standard range on each of the three counts, with the terms to be served consecutively. The new sentence has a minimum of just one year less than the original, Iannamorelli said, or 39 to 78 years.
