Family sues Macy's, Monroeville Mall over shooting that injured 3

A Murrysville family is suing Macy's and the owners of Monroeville Mall, claiming they failed to provide adequate security before a February shooting that wounded two of them and a third person.

Thomas Singleton, 49, his wife, Mary, 48, and their son Dylan, a minor whose age was not available, accuse Macy's Retail Holdings Inc., CBL and Associates Properties Inc. — the Chattanooga, Tenn.-based company that owns the mall — and other companies affiliated with CBL of failing to install adequate security cameras and not taking other steps to improve security, despite warnings about rising levels of crime in Monroeville.

The Singletons seek damages in excess of $35,000 for each of the four counts in their complaint.

CBL spokeswoman Stacey Keating said the company does not comment on pending and ongoing litigation.

“Questions related directly to the incident should be directed to Macy's as it occurred in their store,” she wrote in an emailed statement.

Macy's spokeswoman Elina Kazan said the company does not comment on pending litigation.

Thomas and Mary Singleton each were shot once when they walked between alleged shooter Tarod Thornhill and Davon Jones at Macy's on Feb. 7. Police said Jones, who also was shot, was Thornhill's intended target.

Dylan Singleton was with his parents during the shooting but was uninjured.

The Singletons' complaint, filed Oct. 9 in the Allegheny County Court of Common Pleas, accuses CBL and Macy's of failing to install security cameras and take other measures to prevent the shooting.

John Richardson, the Singletons' attorney, declined to comment beyond the information in the complaint.

Thornhill, 17, is awaiting trial, according to court records. He is charged as an adult with attempted homicide, firearms violations, aggravated assault and reckless endangerment.
