N.J. company sued over ‘Do Not Call’ list violations

A New Jersey company that allegedly contacted consumers on Pennsylvania's "Do Not Call" list faces a lawsuit, according to Attorney General Mike Fisher.

Juno Marketing LLC and Juno Marketing Inc., of Trenton, N.J., is accused of attempting to sell wireless phone services for AT&T Wireless Services to Pennsylvania consumers who had placed their names on the statewide "no call" registry.

According to investigators, the company failed to purchase the list and illegally contacted more than 100 consumers between Nov. 1, 2002, and January 2003, violating Pennsylvania's Consumer Protection Law and Telemarketer Registration Act.

Under the act, consumers may place their name on a "no call" registry. Telemarketers selling goods and services by phone were required to follow the list as of Nov. 1, 2002.

The suit also alleges the company was capable of revealing its name and telephone number on consumers' caller identification systems but failed to do so.

If convicted, the company could forfeit its right to conduct telemarketing in Pennsylvania. It also may have to pay civil penalties, or $1,000 per violation and $3,000 per violation involving a consumer age 60 or older, and also might have to pay the state's investigation costs.
