Scottdale puts hold on code issues

Scottdale Borough Council put several code enforcement issues on hold Monday night since solicitor John Toohey was not present.

But Councilman Andy Pinskey presented members with a report from the protection committee.

Pinskey said the committee met to discuss the way code enforcement is handled in the borough following numerous months of complaints by residents. He said they feel there should be changes made to Scottdale’s ordinance dealing with the International Property Maintenance Code.

The committee will look at the ordinance, come up with any necessary changes and bring those recommendations back to council.

Pinskey said committee members also felt they should opt out of the Uniform Construction Code, which he felt could be done pretty easily.

Other council members felt they should have more clarification from a solicitor on the issue before they take any action, however.

Currently, the code enforcement officer is sent out when the borough receives a complaint.

Pinskey also said almost 90 percent of the complaints made are anonymous. He suggested the borough adopt a complaint form, which complainants would have to obtain from the borough office and fill out, including their name.

“This will help with the efficiency of the staff and also, there will be something on record for us,” he said.

But Councilman Bryce King questioned whether they had to give their names.

Again, other council members wanted to get some clarification on this issue from a solicitor.

Last month, a Fay-Penn representative approached council about helping vendors pull together a viable Farmers Market in Scottdale. Bob Junk stressed then that Fay-Penn does not own the markets and asked that the borough be willing to put the market as a rider on its insurance.

A motion was made and passed to put the Farmers Market under the auspices of the Scottdale Town Center Revitalization Committee and to provide liability insurance.

Council agreed Monday to set the liability insurance amount for individual vendors at $500,000 on their homeowners insurance policy. Also Monday, Junk returned and updated council on the progress of the venture.

At this point, the market would be held on Friday nights from 5 to 7:30 July 1 through Sept. 16.

“We would like to have it in the Rite Aid parking lot, but we understand there could be some construction there this summer, so if it’s not feasible, we’ll move to the library or somewhere else that can accommodate us,” Junk said.

The Farmers Market will be held rain or shine unless there are thunderstorms or high winds.

He added that wineries are allowed to be part of the Farmers Market, but they are not permitted to have open bottles at the market. Also, the vendors are not allowed to promote their food as organic unless they have an organic certification through the United States Department of Agriculture.
