Tyree’s attorney barred from gaining records

A federal judge Friday barred Scott Tyree's attorney from obtaining the Virginia medical and child welfare records of a Crafton Heights girl he allegedly abducted on New Year's Day.

Senior U.S. District Judge William L. Standish quashed the trial subpoenas Tyree's court-appointed attorney, R. Damien Schorr, used to request Fairfax Hospital and Fairfax County Child Protective Services records belonging to 13-year-old Alicia Kozakiewicz. Standish said Tyree, 38, of Herndon, Va., cannot obtain the records without a court order.

Schorr also must present to the court within three days a list of all other trial subpoenas he has issued in the case, Standish said.

U.S. Attorney Mary Beth Buchanan argued that revealing the records would infringe on the victim's privacy and that federal guidelines preclude Tyree from viewing the records.

Federal rules in criminal proceedings allow Tyree to view only evidence that prosecutors intend to use against him at trial or any exculpatory evidence, Buchanan said.
